Mae adran 1 o Ddeddf Awdurdodau Lleol (Nwyddau a Gwasanaethau) 1970 (“Deddf 1970”) yn nodi at ba ddibenion y caiff Cyngor Sir neu Gyngor Bwrdeistref Sirol yng Nghymru (ymhlith eraill) ymrwymo mewn cytundeb â chorff cyhoeddus ynghylch cyflenwi nwyddau a gwasanaethau gan y Cyngor hwnnw.

O dan adran 1(5) o Ddeddf 1970, mae gan Gynulliad Cenedlaethol Cymru, at ddibenion Deddf 1970, y pŵer i bennu yn gorff cyhoeddus berson neu ddisgrifiad o bersonau yr ymddengys iddo eu bod yn arfer swyddogaethau o natur gyhoeddus.

Mae erthygl 2 o'r Gorchymyn hwn yn dynodi PBS 2003 Limited yn gorff cyhoeddus o dan adran 1(5) o Ddeddf 1970.

Yn erthygl 3 o'r Gorchymyn hwn, ceir cyfyngiadau ar y cytundebau y caniateir ymrwymo iddynt.

Effaith y dynodiad hwnnw yw caniatáu i Gyngor Bwrdeistref Sirol Rhondda Cynon Taf ddarparu gwasanaethau arlwyo a chynnal a chadw tiroedd (neu'r naill neu'r llall o'r gwasanaethau hynny) i PBS 2003 Limited drwy gytundeb sydd at unrhyw ddiben a ragnodir gan adran 1(1) o Ddeddf 1970.
