Darpariaeth drosiannol ac amddiffyniad mewn perthynas ag allforion

10.  Mewn unrhyw achosion am dramgwydd o dan y Rheoliadau hyn bydd yn amddiffyniad i unrhyw berson a gyhuddir brofi —

(a)(i)bod y weithred wedi ei chyflawni cyn 1 Awst 2004; a

(ii)na fyddai'r materion sy'n dramgwydd honedig wedi bod yn dramgwydd o dan Reoliadau Cynhyrchion Cig a Chynhyrchion Pysgod Taenadwy 1984(1) fel yr oeddent yn union cyn i'r Rheoliadau hyn ddod i rym; neu

(b)bod y bwyd yr honnir bod y tramgwydd wedi digwydd mewn perthynas ag ef —

(i)wedi'i fwriadu i'w allforio ac yn cydymffurfio â deddfwriaeth ddomestig y wlad sy'n mewnforio sy'n berthnasol i'r tramgwydd a honnir; neu

(ii)lle bo achos o dramgwydd o dan reoliad 4 neu 5, ei fod wedi'i fwriadu ar gyfer ei allforio a'i fod wedi'i farcio neu wedi'i labelu cyn 1 Awst 2004.
