The Care Homes (Wales) (Amendment) Regulations 2004

The National Assembly for Wales, in exercise of the powers conferred upon it by section 22(1) and (2)(d) and section 118(7) of the Care Standards Act 2000(1), hereby makes the following Regulations:

Citation, commencement and application

1.—(1) These Regulations may be cited as the Care Homes (Wales) (Amendment) Regulations 2004 and shall come into force on 31st May 2004.

(2) These Regulations apply in relation to Wales.

Amendment of the Care Homes (Wales) Regulations 2002

2.  In Regulation 2(1) of the Care Homes (Wales) Regulations 2002(2) (interpretation), in the definition of “health care professional”, for “, child psychotherapist or speech therapist” there is substituted “or child psychotherapist”.

Explanatory Note

(This note is not part of the Regulations)

These amending Regulations remove the reference to speech therapists from the definition of “health care professional” in the Care Homes (Wales) Regulations 2002. This reflects the fact that speech therapists are now part of the profession of speech and language therapists, which is covered by section 60(2) of the Health Act 1999 as a profession regulated by the Health Professions Order 2001 (S.I. 2002 No.254).

2000 c. 14. The powers are exercisable by the appropriate Minister (see the definition of “regulations” in section 121(1) of the 2000 Act). The “appropriate Minister” is defined in section 121(1) as the Assembly in relation to Wales, and as the Secretary of State in relation to England, Scotland and Northern Ireland. The “Assembly” is defined in section 5(b) as the National Assembly for Wales.
