Datganiad gan awdurdod cynllunio lleol

8.—(1) Os yw apêl wedi'i wneud i'r Cynulliad Cenedlaethol yn erbyn hysbysiad gorfodi a ddyroddwyd gan awdurdod cynllunio lleol, rhaid i'r awdurdod anfon i'r Cynulliad Cenedlaethol, ac at unrhyw berson y mae copi o'r hysbysiad gorfodi wedi'i gyflwyno iddo, ddatganiad sy'n dangos y cyflwyniadau y mae'n bwriadu rhoi gerbron ynglŷn â'r apêl, gan gynnwys—

(a)crynodeb o ymateb yr awdurdod i bob sail i'r apêl y mae'r apelydd yn ei wneud; a

(b)datganiad sy'n dweud a fyddai'r awdurdod yn fodlon rhoi caniatâd cynllunio i'r materion yr honnir yn yr hysbysiad gorfodi eu bod yn torri'r rheolaeth gynllunio, neu roi cydsyniad adeilad rhestredig neu gydsyniad ardal gadwraeth i'r gwaith y mae'r hysbysiad gorfodi adeilad rhestredig neu hysbysiad gorfodi ardal gadwraeth yn berthnasol iddo, yn ôl y digwydd, ac, os felly, yn rhoi manylion am yr amodau, os oes rhai, y byddai am eu gorfodi ar y caniatâd neu'r cydsyniad.

(2) Rhaid i unrhyw ddatganiad y mae'n ofynnol ei anfon o dan baragraff (1) gyrraedd o fewn 6 wythnos ar ôl y dyddiad dechrau.

(3) Ym mharagraff (2), ystyr “dyddiad dechrau” yw dyddiad—

(a)hysbysiad ysgrifenedig y Cynulliad Cenedlaethol o dan reoliad 9; neu

(b)hysbysiad ysgrifenedig y Cynulliad Cenedlaethol yn unol â Rheolau a wnaed o dan adran 9 o Ddeddf Tribiwnlysoedd ac Ymchwiliadau 1992 sy'n hysbysu'r apleydd a'r awdurdod cynllunio lleol bod ymchwiliad neu wrandawiad, yn ôl y digwydd, i'w gynnal, p'un bynnag yw'r diweddaraf.
