11.  Mewn unrhyw achosion am dramgwydd o dan y Rheoliadau hyn bydd yn amddiffyniad i unrhyw berson a gyhuddir i brofi —

(a)bod y bwyd dan sylw wedi'i farcio neu'i labelu cyn 17 Gorffennaf 2004, a

(b)na fyddai'r materion sy'n gwneud y tramgwydd honedig wedi gwneud tramgwydd o dan Reoliadau Llaeth Cyddwys a Llaeth Sych 1977 fel yr oeddent yn union cyn i'r rheoliadau hyn ddod i rym.
