Amddiffyniad mewn perthynas ag allforion

8.  Mewn unrhyw achosion o dramgwydd o dan y Rheoliadau hyn bydd yn amddiffyniad i unrhyw berson a gyhuddir i brofi —

(a)bod y bwyd yr honnir bod tramgwydd wedi'i gyflawni mewn perthynas ag ef wedi'i fwriadu ar gyfer ei allforio i wlad (heblaw Gwladwriaeth AEE) y mae ganddi ddeddfwriaeth gyfatebol i'r Rheoliadau hyn a bod y bwyd yn cydymffurfio â'r ddeddfwriaeth honno; a

(b)yn achos allforio i Wladwriaeth AEE, bod y ddeddfwriaeth yn cydymffurfio â darpariaethau Cyfarwyddeb y Cyngor 2001/112/EC sy'n ymwneud â suddoedd ffrwythau a chynhyrchion penodol tebyg a fwriedir ar gyfer eu bwyta gan bobl(1).
