Amddiffyniad mewn cysylltiad ag allforion

9.  Mewn unrhyw achosion yn ymwneud â thramgwydd o dan y Rheoliadau hyn bydd profi'r canlynol yn amddiffyniad i'r person a gyhuddir—

(a)bod y bwyd yr honnir bod y tramgwydd wedi'i gyflawni mewn cysylltiad ag ef wedi'i fwriadu ar gyfer ei allforio i wlad a chanddi ddeddfwriaeth sy'n cyfateb i'r Rheoliadau hyn a bod y bwyd yn cydymffurfio â'r ddeddfwriaeth honno; a

(b)yn achos allforio i Wladwriaeth yr AEE, bod y ddeddfwriaeth yn cydymffurfio â darpariaethau Cyfarwyddeb 2000/36/EC Senedd Ewrop a'r Cyngor sy'n ymwneud â chynhyrchion siocled a fwriedir ar gyfer eu bwyta gan bobl(1).
