Disgrifiadau neilltuedig

5.  Ni chaiff unrhyw berson werthu unrhyw fwyd â label, pa un a yw ynghlwm wrth y papur lapio neu'r cynhwysydd neu wedi'i argraffu arnynt, os yw'r label yn ddisgrifiad neilltuedig neu'n deillio o ddisgrifiad neilltuedig, neu os yw'r label yn dwyn neu'n cynnwys disgrifiad neilltuedig neu rywbeth sy'n deillio o ddisgrifiad neilltuedig neu unrhyw air neu ddisgrifiad sy'n sylweddol debyg i ddisgrifiad neilltuedig onid yw —

(a)y bwyd hwnnw'n gynnyrch dynodedig y mae'r disgrifiad neilltuedig yn ymwneud ag ef;

(b)y disgrifiad hwnnw, neu'r peth hwnnw sy'n deillio ohono neu'r gair hwnnw'n cael eu defnyddio mewn cyd-destun sydd yn dangos yn benodol neu'n awgrymu'n glir nad yw'r sylwedd y mae'n cyfeirio ato ond yn un o gynhwysion y bwyd hwnnw; neu

(c)bod y disgrifiad hwnnw, y peth hwnnw sy'n deillio ohono neu'r gair hwnnw yn cael eu defnyddio mewn cyd-destun sy'n dangos yn benodol neu'n awgrymu'n glir nad yw'r bwyd hwnnw'n gynnyrch dynodedig ac nad yw'n cynnwys cynnyrch dynodedig.
