12.  Mewn unrhyw achos mewn cysylltiad â thramgwydd o dan y Rheoliadau hyn bydd profi'r canlynol yn amddiffyniad i'r person a gyhuddir —

(a)marciwyd neu labelwyd y bwyd o dan sylw cyn 3 Awst 2003, a

(b)ni fyddai'r materion yr honnir eu bod yn dramgwydd, wedi bod yn dramgwydd o dan Reoliadau Cynhyrchion Coco a Siocled 1976 fel yr oedd y Rheoliadau yn union cyn dyddiad dod i rym y Rheoliadau hyn.
