Llygredd trawsffiniol

9.—(1) Os yw lefel osôn mewn unrhyw barth yng Nghymru yn uwch na gwerth targed neu amcan hirdymor, a bod y gormodiant hynny wedi'i achosi i raddau helaeth, ym marn y Cynulliad Cenedlaethol, gan allyriannau rhagsylweddion mewn un o Aelod Wladwriaethau eraill yr Undeb Ewropeaidd, rhaid i'r Cynulliad Cenedlaethol hysbysu'r Ysgrifennydd Gwladol.

(2) Os yw'r Ysgrifennydd Gwladol yn llunio cynllun neu raglen ar y cyd, neu gynllun gweithredu tymor byr ar y cyd, gydag un o Aelod Wladwriaethau eraill yr Undeb Ewropeaidd, gan gydymffurfio â dyletswydd a osodwyd gan y Gymuned, rhaid i'r Cynulliad Cenedlaethol weithredu yn ôl yr hyn sydd o fewn ei bwerau i roi'r cynllun hwnnw neu'r rhaglen honno ar waith yng Nghymru.

(3) At ddibenion y rheoliad hwn, ystyr “dyletswydd a osodwyd gan y Gymuned” yw dyletswydd a osodwyd ar y Deyrnas Unedig gan Erthygl 8(1) neu (2) o Gyfarwyddeb 2002/3/EC o'r Senedd Ewropeaidd a'r Cyngor sy'n ymwneud ag osôn yn yr aer amgylchynol(1).
