Pwerau swyddogion Cynulliad Cenedlaethol Cymru, yr Ysgrifennydd Gwladol ac arolygwyr awdurdodau lleol os bydd methiant

9.—(1) Os bydd unrhyw berson y mae trwydded, awdurdod, caniatâd neu hysbysiad a ddyroddir neu a gyflwynir o dan y Gorchymyn hwn yn methu â chydymffurfio â gofynion y drwydded, yr awdurdod, y caniatâd neu'r hysbysiad, caiff swyddog i Gynulliad Cenedlaethol Cymru, yr Ysgrifennydd Gwladol neu arolygydd awdurdod lleol, heb ragfarnu unrhyw achos am dramgwydd sy'n codi o'r methiant hwnnw, gymryd pob cam angenrheidiol i sicrhau y cydymffurfir â gofynion y drwydded, yr awdurdod, y caniatâd neu'r hysbysiad ac os methir â chydymffurfio â'r gofynion hynny bydd y swyddog neu'r arolygydd yn peri i'r gofynion hynny gael eu cyflawni.

(2) Bydd swm unrhyw dreuliau y mae swyddog i Gynulliad Cenedlaethol Cymru, yr Ysgrifennydd Gwladol neu arolygydd awdurdod lleol yn mynd yn rhesymol iddynt wrth arfer unrhyw bŵ er a roddwyd iddynt gan baragraff (1) uchod yn adferadwy fel dyled sifil pan fydd Cynulliad Cenedlaethol Cymru, yr Ysgrifennydd Gwladol neu'r awdurdod lleol, yn ôl fel y digwydd, yn gofyn am y swm hwnnw oddi wrth y person sy'n methu â chydymffurfio.
