Tramgwyddau

10.—(1) Yn ddarostyngedig i baragraff (2), bydd yn dramgwydd o dan y Ddeddf i unrhyw berson sydd, heb awdurdod neu esgus cyfreithiol, a hwnnw'n awdurdod neu'n esgus y bydd rhaid iddo ei brofi—

(a)yn torri unrhyw ddarpariaeth yn y Gorchymyn hwn neu unrhyw ddarpariaeth mewn trwydded, awdurdod, caniatâd neu hysbysiad a ddyroddwyd neu a gyflwynwyd odani; neu

(b)yn achosi neu'n caniatáu unrhyw doriad neu ddiffyg cydymffurfedd o'r fath.

(2) Ni fydd paragraff (1) yn gymwys i hysbysiad a roddir o dan erthygl 3(10).
