5.—(1) Pan gaiff penodiad y person a benodwyd ei ddiddymu o dan baragraff 2(c) mewn perthynas ag unrhyw apêl neu fater, rhaid i'r Cynulliad Cenedlaethol, oni bai ei fod yn bwriadu penderfynu'r apêl neu'r mater ei hun, benodi person arall o dan reoliad 15(8) i benderfynu ar yr apêl neu'r mater yn ei le .

(2) Pan gaiff penodiad newydd o'r fath ei wneud, rhaid i'r broses o ystyried yr apêl neu'r mater, neu unrhyw ymchwiliad lleol neu wrandawiad arall mewn perthynas ag ef, gael ei dechrau o'r newydd.

(3) Ni fydd dim yn is-baragraff (2) yn ei gwneud hi'n ofynnol i unrhyw berson gael cyfle i wneud sylwadau o'r newydd neu addasu unrhyw sylwadau a wnaed eisoes neu eu tynnu yn eu hôl.
