Rheoliadau Asesu Effeithiau Amgylcheddol (Tir heb ei Drin ac Ardaloedd Lled-naturiol) (Cymru) 2002

4.—(1) Bydd darpariaethau'r paragraff hwn, yn hytrach na rheoliad 15(6), yn gymwys i apêl sydd i'w phenderfynu gan berson a benodwyd.

(2) Os bydd yr apelydd yn mynegi ei fod yn dymuno ymddangos gerbron y person a benodwyd ac i gael ei glywed ganddo , rhaid i'r person a benodwyd roi cyfle i'r apelydd ymddangos a chael ei glywed.

(3) P'un a yw apelydd wedi gofyn am gyfle i ymddangos gerbron ac i gael ei glywed ai peidio—

(a)caiff y person a benodwyd gynnal ymchwiliad lleol neu wrandawiad arall mewn perthynas â'r apêl neu'r mater, a

(b)rhaid iddo gynnal ymchwiliad lleol mewn cysylltiad â'r apêl neu'r mater, os bydd y Cynulliad Cenedlaethol yn ei gyfarwyddo i wneud hynny.

(4) Os yw'r naill neu'r llall o is-baragraffau (2) neu (3) uchod yn gymwys, rhaid i'r person a benodwyd hysbysu'r apelydd ac unrhyw bersonau eraill sydd wedi hysbysu'r Cynulliad Cenedlaethol eu bod am wneud sylwadau yn unol â rheoliad 15(5) fod gwrandawiad neu ymchwiliad lleol, yn ôl fel y digwydd, i'w gynnal.

(5) Pan fydd person a benodwyd yn cynnal ymchwiliad lleol neu wrandawiad arall yn rhinwedd yr Atodlen hon, caiff y Cynulliad Cenedlaethol benodi aseswr i eistedd gyda'r person a benodwyd yn yr ymchwiliad neu'r gwrandawiad ac i'w gynghori ar unrhyw fater sy'n codi, er mai'r person a benodwyd a fydd yn penderfynu'r apêl neu'r mater.

(6) Yn ddarostyngedig i reoliad 15(9), rhaid i gostau ymchwiliad lleol a gynhaliwyd o dan yr Atodlen hon gael eu had-dalu gan y Cynulliad Cenedlaethol.
