Rheoliadau Asesu Effeithiau Amgylcheddol (Tir heb ei Drin ac Ardaloedd Lled-naturiol) (Cymru) 2002

Cymhwyso'r Rheoliadau hyn

3.—(1) Mae'r Rheoliadau hyn yn gymwys i bob prosiect nad yw'n esempt o dan baragraffau (2) neu (3) isod.

(2) Mae prosiect yn esempt o dan y paragraff hwn os yw:

(a)yn brosiect a ddisgrifir yn rheoliad 3(2) o Reoliadau Asesu Effaith Amgylcheddol (Coedwigaeth) (Lloegr a Chymru) 1999(1);

(b)yn ddatblygiad y mae Rheoliadau Cynllunio Gwlad a Thref (Asesu Effaith Amgylcheddol) (Lloegr a Chymru) 1999(2) yn gymwys iddo; neu

(c)yn gyfystyr â chyflawni gwaith gwella gan gorff traenio o fewn ystyr “drainage body” yn Rheoliadau Asesu Effeithiau Amgylcheddol (Gwaith Gwella Traeniad Tir) 1999(3)

(3) Mae prosiect yn esempt o dan y paragraff hwn i'r graddau y mae'r Cynulliad Cenedlaethol yn cyfarwyddo, yn unol ag Erthygl 2(3) o'r Gyfarwyddeb EIA, ei fod yn esempt rhag y Rheoliadau hyn.

(4) Yn achos prosiect y mae'r Cynulliad Cenedlaethol yn penderfynu y bydd ganddo effaith sylweddol ar safle Ewropeaidd (naill ai ar ei ben ei hun neu ar y cyd â phrosiectau eraill), dim ond i'r graddau y sicrheir cydymffurfedd â'r Gyfarwyddeb Cynefinoedd mewn perthynas â'r prosiect y bydd y pwer i gyfarwyddo bod y prosiect yn esempt rhag y Rheoliadau hyn o dan baragraff (3) uchod yn arferadwy.
