Prosiectau trawsffiniol

12.—(1)  Yn achos prosiect trawsffiniol, os yw'r rhan fwyaf o'r tir perthnasol wedi'i leoli yng Nghymru, rhaid i'r Cynulliad Cenedlaethol ymgynghori â'r Ysgrifennydd Gwladol cyn gwneud pendefyniad sgrinio o dan reoliad 5(4), gan roi barn ar y posibiliadau o dan reoliad 7(4) neu roi neu wrthod rhoi caniatâd o dan reoliad 13(1).

(2) Yn ddarostyngedig i baragraff (4) isod, yn achos prosiect trawsffiniol lle mae'r rhan fwyaf o'r tir perthnasol wedi'i leoli yn Lloegr, bydd y prosiect hwnnw yn ddarostyngedig yn unig i'r rheoliadau cyfatebol sy'n berthnasol i'r prosiect yn Lloegr.

(3) Os bydd yr Ysgrifennydd Gwladol yn gofyn am hynny, caiff y Cynulliad Cenedlaethol gytuno y gall cais mewn perthynas â phrosiect trawsffiniol y byddai'r Rheoliadau hyn fel arall yn berthnasol iddo yn ddarostyngedig i'r rheoliadau cyfatebol sy'n berthnasol i'r prosiect yn Lloegr yn unig.

(4) Ni fydd paragraff (2) o'r rheoliad hwn yn gymwys os bydd yr Ysgrifennydd Gwladol yn cytuno â chais gan y Cynulliad Cenedlaethol yn unol â rheoliad 12(3) o Reoliadau Asesu Effeithiau Amgylcheddol (Tir heb ei Drin ac Ardaloedd Lled-naturiol) (Lloegr) 2001(1).
