Cyfyngiadau ar dalu cymorth

7.—(1) Ni fydd cymorth yn daladwy ar gyfer cais ar gyfer unrhyw gyfnod cyn y dyddiad derbyn.

(2) Caiff y Cynulliad Cenedlaethol wrthod neu leihau cymorth a fyddai'n dyblygu unrhyw gymorth a roddwyd o'r blaen neu sydd i'w roi allan o arian sy'n cael ei ddarparu gan y Senedd neu gan y Gymuned Ewropeaidd, ac i'r perwyl hwn cymerir bod cymorth yn gymorth a fyddai'n dyblygu cymorth o'r fath os byddai (os câi ei dalu) yn cael ei dalu at unrhyw un o'r un dibenion ar gyfer unrhyw ran o'r un tir.

(3) Rhaid peidio â gwneud unrhyw daliad cymorth ar gyfer parsel organig nes i'r Cynulliad Cenedlaethol gael tystysgrif gofrestru ar gyfer y parsel organig hwnnw neu gadarnhâd gan yr awdurdod archwilio y bydd tystysgrif yn cael ei roi.

(4) Ni fydd cymorth yn daladwy ar gyfer unrhyw barsel organig, nac unrhyw uned organig sy'n cynnwys tir y mae cais yn ymwneud ag ef,—

(a)sy'n hollol organig ar y dyddiad dod i law; neu

(b)sydd wedi bod yn hollol organig ar unrhyw bryd yn ystod y cyfnod a ddechreuodd ar 1 Ionawr 1997 ac sy'n dod i ben ar y dyddiad derbyn.

(5) Ni fydd cymorth yn daladwy o dan Ran I o Atodlen 1 ar gyfer unrhyw barsel organig ar gyfer unrhyw gyfnod sy'n dechrau fwy na phum mlynedd ar ôl y dyddiad y daeth y taliad cymorth cyntaf yn daladwy arno ar gyfer y parsel organig hwnnw.

(6) Ni fydd cymorth yn daladwy am fwy na 300 hectar o gyfanswm arwynebedd tir cymwys CTATA, cnydau parhaol a thir caeedig ar unrhyw ddaliad sy'n destun cais.
