Gorchmynion costau a threuliau

20.—(1) Ac eithrio fel y darperir gan baragraff 17(1), rhaid i'r tribiwnlys beidio â gwneud gorchymyn fel rheol i ddyfarnu costau a threuliau, ond yn ddarostyngedig i is-baragraff (2), fe gaiff wneud gorchymyn o'r fath yn erbyn person os yw o'r farn bod y person hwnnw wedi gweithredu'n wacsaw neu'n flinderus neu fod ei ymddygiad wedi bod yn hollol afresymol.

(2) Rhaid peidio â gwneud gorchymyn o dan is-baragraff (1) yn erbyn person heb i'r person hwnnw gael cyfle i gyflwyno sylwadau yn erbyn gwneud y gorchymyn.

(3) Gall gorchymyn o dan is-baragraff (1) ei gwneud yn ofynnol i'r person y mae'n cael ei wneud yn ei erbyn dalu i berson arall naill ai swm penodedig mewn perthynas â'r costau a'r treuliau a dynnwyd gan y person arall hwnnw mewn cysylltiad â'r dyfarniad neu'r cyfan neu ran o'r costau hynny fel y maent wedi'u asesu (os na chytunir fel arall).

(4) Bydd unrhyw gostau y mae gorchymyn o dan y paragraff hwn yn ei gwneud yn ofynnol iddynt gael eu hasesu yn cael eu hasesu yn y llys sirol ar y sail safonol.

(5) Bydd swm penodedig unrhyw gostau a threuliau a ddyfernir gan dribiwnlys neu swm y costau a'r treuliau hynny ar ôl ei asesu, onid yw'n cael ei neilltuo ac yn ddarostyngedig i unrhyw amrywiad yn sgil apêl neu adolygiad, yn dwyn llog o'r pedwerydd diwrnod ar ddeg ar ôl dyddiad dyfarnu'r costau yn ôl y gyfradd sy'n cael ei rhagnodi am y tro o dan adran 69 o Ddeddf Llysoedd Sirol 1984(1).

(6) Gellir caslgu swm penodedig unrhyw gostau a threuliau neu swm y rheiny fel y mae wedi'i asesu ynghyd ag unrhyw log arnynt drwy atafaeleb a roddir gan lys sirol.
