The Community Health Councils Amendment (Wales) Regulations 2000

The National Assembly for Wales makes the following Regulations in exercise of the powers conferred on the Secretary of State for Wales by section 126(4), 128(1) and paragraph 2(a) of Schedule 7 to the National Health Service Act 1977(1) and of all other powers enabling the Secretary of State in that behalf and now vested in the National Assembly for Wales(2).

Citation, commencement, interpretation and application

1.—(1) These Regulations may be cited as the Community Health Councils Amendment (Wales) Regulations 2000 and shall come into force on 1st March 2000.

(2) In these Regulations “the 1996 Regulations” means the Community Health Councils Regulations 1996(3).

(3) These Regulations shall apply to Wales only.

Amendment of the 1996 Regulations

2.  In regulation 3 of the 1996 Regulations after paragraph (2) there shall be inserted the following paragraph—

(2A) In the event of the term of office of every member of a Council whose district is situated in Wales expiring on the same date, the term of office of all members appointed in consequence thereof shall be settled in accordance with the same provisions as are applied by paragraph (2) above in relation to first appointments..

Explanatory Note

(This note is not part of the Regulations)

These Regulations have effect to amend the Community Health Councils Regulations 1996 (“the 1996 Regulations”) by providing that regulation 3(2) of the 1996 Regulations shall apply in the event of the terms of office of every member of a Council terminating on the same date which situation will arise in the case of all Councils in Wales on 31st March 2000.

The terms of office of members appointed to Councils in consequence of this event shall be settled as if they were on first appointment upon the establishment of a new council. As such the terms of some members will overlap with the terms of others as provided for by regulation 3(2).
