Tramgwyddau a chosbau

7.  Bydd unrhyw berson —

(a)sy'n gwerthu unrhyw fwyd y mae gofynion labelu Rheoliad 1139/98 neu Reoliad 50/2000 yn gymwys iddo ac nad yw wedi'i farcio neu wedi'i labelu â'r manylion GMO, ac eithrio yn achos unrhyw fwyd y mae rheoliad 5(3) yn gymwys iddo ac y mae manylion amgen yn cael eu dangos ynglŷn ag ef yn unol â rheoliad 5(4),

(b)sy'n gwerthu unrhyw fwyd nad yw wedi'i farcio neu wedi'i labelu yn unol â rheoliad 4, 5 neu 6, neu

(c)sy'n rhoi ar y farchnad unrhyw fwyd newydd neu gynhwysyn bwyd newydd nad yw'r gofynion ychwanegol ynglŷn â hwy mewn perthynas â gwybodaeth i fwytawyr a nodir yn Erthygl 8(1) o Rheoliad 258/97 wedi'u bodloni,

yn euog o dramgwydd a bydd yn agored i ddirwy na fydd yn fwy na lefel 5 ar y raddfa safonol o'i gollfarnu'n ddiannod.
