Esemptiadau

3.—(1) Yn ddarostyngedig i baragraff (2) isod, ni fydd y Rheoliadau hyn yn gymwys mewn perthynas ag unrhyw fwyd y deuir ag ef i mewn i Gymru o ran arall o'r Deyrnas Unedig neu o Aelod-wladwriaeth (heblaw'r Deyrnas Unedig) —

(a)os cafodd ei werthu'n gyfreithlon yn y rhan o'r Deyrnas Unedig neu yn yr Aelod-wladwriaeth y daethpwyd ag ef i Gymru ohoni,

(b)os cafodd ei gynhyrchu mewn Aelod-wladwriaeth neu os oedd yn cael ei gylchredeg yn ddirwystr yn y rhan o'r Deyrnas Unedig neu yn yr Aelod-wladwriaeth y daethpwyd ag ef i Gymru ohoni, ac

(c)os yw gofynion Rheoliad 1139/98 neu Reoliad 50/2000 (fel y bo'n gymwys), fel y'u darllenir yn y naill achos a'r llall gyda Chyfarwyddeb 79/112, wedi'u bodloni mewn perthynas â'r bwyd hwnnw.

(2) Ni fydd dim ym mharagraff (1) uchod yn atal gorfodi rheoliad 7(c).

(3) At ddibenion paragraff (1) uchod, mae i “cylchredeg yn ddirwystr” yr un ystyr â “free circulation” yn Erthygl 23(2) o'r Cytuniad yn sefydlu'r Gymuned Ewropeaidd.

(4) Nid oes angen marcio na labelu â'r manylion GMO unrhyw fwyd wedi'i ragbacio, sydd naill ai wedi'i gynnwys mewn potel wydr ac arni farc annileadwy ac y bwriedir ei hailddefnyddio ac nad oes arni label, cylch na choler, neu y mae gan wyneb mwyaf ei becyn arwynebedd o lai na deg centimetr sgwâr.
