The General Teaching Council for Wales (Constitution) (Amendment) Regulations 1999

The National Assembly for Wales makes the following Regulations in exercise of the powers conferred on the Secretary of State by sections 1(5) and (7) of, and paragraph 3 of Schedule 1 to the Teaching and Higher Education Act 1998(1) and now vested in the National Assembly for Wales(2):

Citation and commencement

1.  These Regulations may be cited as the General Teaching Council for Wales (Constitution) (Amendment) Regulations 1999 and shall come into force on 29th October 1999.

Amendment of the General Teaching Council for Wales (Constitution) Regulations 1999

2.  The General Teaching Council for Wales (Constitution) Regulations 1999(3) shall be amended in accordance with regulations 3, 4, 5 and 6 below.

3.  In paragraph (1) of regulation 2 —

(a)the definitions of “primary school”, “secondary school” and “special school” shall be omitted;

(b)after the definition of “the Council” there shall be inserted — “junior pupils” means children who have not attained the age of 12;

(c)after the definition of “members” there shall be inserted —

“senior pupils” means persons who have attained the age of 12..

4.  For paragraph (2) of regulation 2 there shall be substituted —

(2) In regulations 4 and 9 references to “teachers” shall only include a person who

(a)on and after the date of establishment of a register of teachers under section 3 of the 1998 Act, is a registered teacher; and

(b)before that date, is a qualified teacher within the meaning of section 218(2) of the 1988 Act.

5.  For regulation 4 there shall be substituted the following —

4.  The elected members shall comprise —

(a)four teachers of junior pupils;

(b)four teachers of senior pupils;

(c)four head or deputy head teachers..

6.  In regulation 9, after the word “Council” there shall be inserted the words “are teachers who”.

Explanatory Note

(This note is not part of the Regulations)

The effect of this amendment is to enable teachers who teach in nursery schools, special schools and in further education to stand for election to the General Teaching Council for Wales, whereas, previously, the wording of the General Teaching Council for Wales (Constitution) Regulations 1999 did not permit them to do so.

For this purpose, “teachers” means a teacher qualified within the meaning of section 218(2) of the Education Reform Act 1988; or, once a register of teachers is established by the General Teaching Council for Wales, a registered teacher.

These Regulations amend the General Teaching Council for Wales (Constitution) Regulations 1999 so that the elected members of the General Teaching Council for Wales will comprise :

(a)four teachers of junior pupils (persons under 12 years old);

(b)four teachers of senior pupils (persons of 12 years or over);

(c)four head or deputy head teachers.
