Coming into force

The Office for Students, in exercise of the powers conferred by section 45(1) of the Higher Education and Research Act 20171, makes the following Order.

The Office for Students has requested advice from the relevant body regarding the quality of, and standards applied to, higher education provided by the provider, and has had regard to that advice in accordance with section 46(1)(c) and (7) of that Act.

The Office for Students has complied with the procedure on giving notifications in accordance with section 48 of that Act.

Citation and commencement1

This Order may be cited as the Power to Award Degrees etc. (New College Durham) Order of Council 2017 (Amendment) Order 2023 and shall come into force on 31st July 2023.

Variation of Power to Award Degrees etc. (New College Durham) Order of Council 20172

The Power to Award Degrees etc. (New College Durham) Order of Council 2017 is varied in accordance with paragraphs (2) and (3).

For article 2, substitute—

New College Durham (registered company number 07195175) shall be competent to grant awards of the kind mentioned in paragraph 2A of section 76 of the said Act for an indefinite period.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order varies New College Durham’s existing Degree Awarding Powers authorisation so that it remains valid indefinitely. This Order also removes the restrictions stated in articles 3 and 4 of the Power to Award Degrees etc. (New College Durham) Order of Council 2017 so that New College Durham may now authorise other institutions to grant awards on its behalf, and so that New College Durham may grant awards to persons who were not enrolled at the institution at the time they completed the course of study for which the award is granted.

An impact assessment has not been produced for this instrument as it has no impact on businesses and civil society organisations. The instrument has no impact on the public sector.
