The Secretary of State, in exercise of the powers conferred by sections 113A(1)(b), 113B(1)(b) and 125 of the Police Act 1997(1) as extended to the Isle of Man by the Police Act 1997 (Criminal Records) (Isle of Man) Order 2010(2), makes the following Regulations.

In accordance with article 9 of the Police Act 1997 (Criminal Records) (Isle of Man) Order 2010, the Secretary of State has consulted the Department of Home Affairs of the Isle of Man.

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Police Act 1997 (Criminal Records and Registration) (Isle of Man) (Amendment) Regulations 2022 and come into force on 6th April 2022.

(2) These Regulations extend to the Isle of Man.

Amendments to the Police Act 1997 (Criminal Records and Registration) (Isle of Man) Regulations 2011

2.—(1) The Police Act 1997 (Criminal Records and Registration) (Isle of Man) Regulations 2011(3) are amended as follows.

(2) In regulation 3 (fees for criminal record certificates and enhanced criminal records certificates)—

(a)in sub-paragraph (a), for “£23”, substitute “£18”;

(b)in sub-paragraph (b), for “£40”, substitute “£38”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the prescribed fees in the Police Act 1997 (Criminal Records and Registration) (Isle of Man) Regulations 2011 (S.I. 2011/2296).

The fees for criminal record certificates (also known as standard certificates) are reduced from £23 to £18, and the fees for enhanced criminal record certificates are reduced from £40 to £38. This will mirror the fee reductions applied to applications in England and Wales.

The amended fees apply to applications for criminal record certificates and enhanced criminal records certificates in the Isle of Man.

1997 c. 50. Sections 113A and 113B were inserted by Section 163(2) of the Serious Organised Crime and Police Act 2005 (c. 15), and amended by paragraph 1 of Schedule 8 to the Policing and Crime Act 2009 (c. 26), by section 80(1) of the Protection of Freedoms Act 2012 (c. 9) and by S.I. 2012/3006. There are other amending instruments but none are relevant.

S.I. 2010/764. Article 3 extended sections 113A, 113B and 125 of the Police Act 1997 to the Isle of Man with modifications. The modifications are made in Schedule 1 of the 2010 Order. The Order was amended by S.I. 2012/2598.
