The Telecommunications Infrastructure (Leasehold Property) Act 2021 (Commencement No. 1) Regulations 2022

The Secretary of State makes these Regulations in exercise of the powers conferred by section 3(4) of the Telecommunications Infrastructure (Leasehold Property) Act 2021(1).

Citation and extent

1.  These Regulations may be cited as the Telecommunications Infrastructure (Leasehold Property) Act 2021 (Commencement No. 1) Regulations 2022.

2.  These Regulations extend to England and Wales and Scotland.

Provisions coming into force in relation to England and Wales on 26th December 2022 and in relation to Scotland on 1st July 2023

3.  The following provisions of the Telecommunications Infrastructure (Leasehold Property) Act 2021 come into force in relation to England and Wales on 26th December 2022 and in relation to Scotland on 1st July 2023—

(a)section 1 (Code rights in respect of land connected to leased premises);

(b)section 2 (Related amendments); and

(c)Schedule (Related amendments).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations bring into force in relation to England and Wales on 26th December 2022 and in relation to Scotland on 1st July 2023 those provisions of the Telecommunications Infrastructure (Leasehold Property) Act 2021 (the “Act”) relating to the electronic communications code which are not already in force. Those provisions are sections 1 and 2 of the Act and the Schedule to the Act. Section 1 inserts provisions relating to code rights in respect of land connected with leased premises as Part 4A of Schedule 3A to the Communications Act 2003. Section 2 provides for related amendments, which are set out in the Schedule to Act.

The Explanatory Notes to the Act provide further explanation of the reforms to the electronic communications code introduced by the Act and are available online (https://bills.parliament.uk/bills/2520/publications) and in hard copy from TSO, PO Box 29, Norwich, NR3 1GN (telephone orders/general enquiries: 0333 202 5070).

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
