Coming into force

The Secretary of State for Education makes these Regulations in exercise of the powers conferred by sections 39(1)(b), 44(1) and 104(2) of the Childcare Act 20061 (“the 2006 Act”).

In accordance with section 43(2) of the 2006 Act, the Secretary of State has consulted His Majesty’s Chief Inspector of Education, Children’s Services and Skills.

Citation and commencement1

These Regulations—

a

may be cited as the Early Years Foundation Stage (Welfare Requirements) (England) (Amendment) Regulations 2022, and

b

come into force on 1st December 2022.

Extent and application2

These Regulations—

a

extend to England and Wales, and

b

apply in relation to England.

Amendment of the Early Years Foundation Stage (Welfare Requirements) Regulations 20123

The Early Years Foundation Stage (Welfare Requirements) Regulations 20122 are amended in accordance with regulation 4.

Amendment to regulation 3 (specification of the welfare requirements)4

In regulation 3(2A), for “paragraphs 3.16, 3.17, 3.18, 3.52, 3.53, 3.77 and 3.78” substitute “paragraphs 3.16, 3.17, 3.18, 3.53, 3.54, 3.78 and 3.79”.

EXPLANATORY NOTE

(This note is not part of these Regulations)

These Regulations amend the Early Years Foundation Stage (Welfare Requirements) Regulations 2012 (S.I. 2012/938) (“the principal Regulations”) to correct a defect.

These Regulations are being issued free of charge to all known recipients of the Early Years Foundation Stage (Miscellaneous Amendments) and Childcare Fees (Amendment) Regulations 2021 (S.I. 2021/432) (“the amendment Regulations”).

The amendment made by regulation 4 is consequential to an earlier amendment to the principal Regulations which came into force on 1st September 2021 by regulation 4 of the amendment Regulations (which incorporated a document in the principal Regulations by reference).

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary, or public sector is foreseen.
