The Secretary of State for Transport, makes this Instrument in exercise of the powers conferred by section 106(3) of the Highways Act 19801, and now vested in the Secretary of State2:

This Instrument may be cited as “The Sunderland City Council (Riverside Sunderland – New River Wear High Level Footbridge) Scheme 2020 Confirmation Instrument 2021” and shall come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

The Sunderland City Council (Riverside Sunderland – New River Wear High Level Footbridge) Scheme 2020 (“the Scheme”) is hereby confirmed.

The Scheme as confirmed is set out in the Schedule (including the plan) and copies of the Scheme with its accompanying plan are deposited at the offices of the Department for Transport, MHCLG, 1 Priory Square, Priory Street, Hastings, East Sussex, TN34 1EA and at the offices of Sunderland City Council at the Civic Centre, Burdon Road, Sunderland SR2 7SN.

Regulation 3

The Sunderland City Council (“the Council”) make this Scheme in exercise of their powers under section 106(3) of the Highways Act 1980 and all other powers enabling them in that behalf.

The Council are authorised to construct over the navigable waters of the River Wear the Footbridge specified in the Schedule to this Scheme required as part of the development of the Riverside and which is required to connect for pedestrian and cycleway purposes only the Vaux Site and the Sheepfolds area situate in the city centre of Sunderland.

This Scheme may be cited as The Sunderland City Council (Riverside Sunderland – New River Wear High Level Footbridge) Scheme 2020.

THE SCHEDULE TO THE SCHEME

PLANS AND SPECIFICATIONS OF THE NEW RIVER WEAR HIGH LEVEL FOOTBRIDGE

The location and general design of the footbridge are shown on the plan numbered SCC-NWF-ATK-SBR-XX-DR-S-000001, Revision P01, titled “New Wear Footbridge Haunched Steel Box Girder General Arrangement”.

POINTS OF COMMENCEMENT AND TERMINATION

From a point on the South Bank of the River Wear 10 metres north-east of “The Beam” building.

To a point on the North Bank of the River Wear 10 metres south of the southern gable wall of the North East Railway Stable Building.

SPAN

The overall span of the Footbridge between the centre line of the bearings on the north and south abutments will be 250 metres, using a 3 span arrangement of 72 metres (North Bank), 125 metres (across the River Wear) and 53 metres (South Bank).

HEADWAY

Not less than 25 metres above the mean high water spring tide level (MHWS) of 2.5 metres above ordnance datum.

WATERWAY

A minimum clear navigable waterway of 30 metres.

OVERALL DIMENSIONS

The footbridge will be 10 metres wide overall and will carry shared surface pedestrian footway and cycleway with a useable deck space of approximately 8.4 metres.

EXPLANATORY NOTE

This instrument confirms a Scheme to construct over the navigable waters of the River Wear the Footbridge specified in the Schedule to this Scheme required as part of the development of the Riverside and which is required to connect pedestrian and cycleway purposes only the Vaux Site and the Sheepfolds area situated in the city centre of Sunderland.

The Secretary of State has modified this Bridge Scheme as follows:

In the Schedule to the Scheme, the paragraph titled ‘PLANS AND SPECIFICATIONS OF THE NEW RIVER WEAR HIGH LEVEL FOOTBRIDGE’, the plan numbered SCC-NWF-ATK-SBR-XX-DR-000001’ has been amended to SCC-NWF-ATK-SBR-XX-DR-S-000001.

In the Schedule to the Scheme, the paragraph titled POINTS OF COMMENCEMENT AND TERMINATION, the word ‘approximately’ has been removed from both sentences.
