The A46 Trunk Road (Coventry Junctions Upgrade (Binley)) (Detrunking) Order 2020

The Secretary of State for Transport makes this Order in exercise of the powers conferred by sections 10 and 12 of the Highways Act 1980(1) and now vested in him(2).

In accordance with Section 10(2) of that Act, the Secretary of State has taken into consideration the requirements of local and national planning, including the requirements of agriculture, and is satisfied as to expediency.

This Order is made in compliance with the provisions of parts I and III of Schedule 1 of that Act.

1.  This Order may be cited as the A46 Trunk Road (Coventry Junctions Upgrade (Binley)) (Detrunking) Order 2020 and shall come into force on 10th June 2020.

2.  In this Order –

(1) All measurements of distance are measured along the route of the relevant highway;

(2) –

(a)“Highways England” means Highways England Company Limited (Company No. 9346363), a strategic highways company, which is a company registered in England and Wales and whose Registered Office is Bridge House, 1 Walnut Tree Close, Guildford, Surrey GU1 4LZ;

(b)“the plan” means the plan numbered [10/MP/004] MARKED “The A46 Trunk Road (A46 Coventry Junctions Upgrade (Binley)) (Detrunking) Order 2020”, signed by authority of the Secretary of State for Transport and deposited at Document Deposit Service, Communities and Local Government, Floor 13 (IMD), Ashdown House, St Leonard’s on Sea, Hastings, East Sussex TN37 7GA;

(c)“classified road” as a classification for a highway, means that the highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads;

(d)“the new trunk roads” means the main new road and the slip roads defined in “The A46 Trunk Road (Coventry Junctions Upgrade (Binley)) (Trunking) Order 2020”, and

(e)“the trunk road” means the Coventry Eastern Bypass Trunk Road (A46).

3.  The length of road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a classified road from the date on which Highways England notifies Warwickshire County Council and Coventry City Council that the new trunk roads are open for traffic.

SCHEDULELENGTH OF THE TRUNK ROAD CEASING TO BE A TRUNK ROAD

The length of the trunk road ceasing to be a trunk road is the whole extent of Binley Junction roundabout between where the new trunk roads meet the outer pavement edge of the Binley Junction roundabout and a length of the A428 Rugby Road from the front edge of the traffic island to the back of the traffic island, marked as R1 and shown by black hatched lines on the plan.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order removes the trunk road status from and makes the Binley Junction roundabout a classified road. The Transfer in classification and responsibility for the roundabout takes place on the date on which Highways England notifies Warwickshire County Council and Coventry City Council that the new trunk road is open to traffic.
