Amendment of the Aviation Safety (Amendment etc.) (EU Exit) Regulations 2019

2.  The Aviation Safety (Amendment etc.) (EU Exit) Regulations 2019(1) are amended in accordance with regulations 3 to 12.

Amendment of Part 3, Chapter 4 (occurrence reporting)

3.  In regulation 66 (amendment of Article 7 of Regulation (EU) No 376/2014), for paragraph (3) substitute—

“(3) In paragraph 4, for “paragraphs 5, 6 and 8” substitute “paragraphs 5 and 6”.”.

4.  In regulation 72 (amendment of Article 17 of Regulation (EU) No 376/2014), omit paragraph (3)(c)(ii).

Amendment of Part 4, Chapter 4 (aircrew)

5.  In regulation 294 (amendment of Article 4 of Commission Regulation (EU) No 1178/2011), for paragraph (3) substitute—

“(3) In paragraph 7—

(a)at the start, for “A Member State” substitute “The CAA”;

(b)in point (a), for “Member State” substitute “CAA”;

(c)in point (b)—

(i)in point (i), for “national territory of the authorising Member State” substitute “United Kingdom”;

(ii)in point (ii), for “authorising Member State” substitute “United Kingdom”;

(d)in point (c), for “Member State” substitute “CAA”;

(e)omit point (d);

(f)in point (e), for “Member States” substitute “CAA”.”.

Amendment of Part 4, Chapter 5 (air operations)

6.  In regulation 339 (amendment of Article 1 of Commission Regulation (EU) No 965/2012), for “Treaty” substitute “Treaties”.

7.  In regulation 344 (amendment of Article 6 of Commission Regulation (EU) No 965/2012), for paragraph (3) substitute—

“(3) In paragraph 3, for the words from “the national law” to “resides” substitute “in any relevant enactment”.”.

8.  In regulation 346 (amendment of Article 8 of Commission Regulation (EU) No 965/2012)—

(a)for paragraph (2) substitute—

“(2) In paragraph 3, for the words from “national law” to the end substitute “Air Navigation Order 2016”.”;

(b)for paragraph (3) substitute—

“(3) In paragraph 4, for the words from “national law” to the end substitute “Air Navigation Order 2016”.”.

9.  Omit regulation 349 (amendment of Article 10 of Commission Regulation (EU) No 965/2012).

10.  In regulation 357 (amendment of the Appendices to Annex 2 to Commission Regulation (EU) No 965/2012), in paragraph (3)(c), for “Issue 3” substitute “Issue 4”.

11.  In regulation 367 (amendment of Annex 5 to Commission Regulation (EU) No 965/2012), after paragraph (5) insert—

“(6) In Subpart M (electronic flight bags (EFBs)), in both places the words occur, for “competent authority” substitute “CAA”.”.

Amendment of Schedule 3 (savings and transitional arrangements)

12.  In Schedule 3 (savings and transitional arrangements)—

(a)in the heading for paragraph 6, for “Regulation (EU) No 2018/1139” substitute “principal EU Regulations”;

(b)in paragraph 6, for “under that provision” substitute “or an implementing act under that provision, or implementing rules under a corresponding provision”.
