22.—(1) The Environment and Safety Information Act 1988(1) is amended in accordance with paragraphs (2) and (3).
(2) In section 2(2) (interpretation)—
(a)in paragraphs (b) and (c) for “or the Secretary of State” substitute “, the Secretary of State or the Welsh Ministers”;
(b)after paragraph (c) (but before the “or” following it) insert—
“(ca)in any case not falling within paragraphs (a) to (c) where the notice is served in Wales, the Welsh Ministers;”.
(3) In section 4(6) (protection of trade secrets etc)—
(a)after paragraph (a) insert—
“(aa)in relation to notices served in Wales under that Act or the Regulatory Reform (Fire Safety) Order 2005(2), the Welsh Ministers;”; and
(b)in paragraph (b), after “paragraph (a)” insert “or (aa)”.
