10.—(1) Article 5 (the specified circumstances) of the Road Safety (Financial Penalty Deposit) Order 2009 is amended as follows.
(2) In paragraph (1), omit “on that occasion”.
(3) For paragraph (2), substitute –
“(2) In paragraph (1) “road”—
(a)in relation to—
(i)England, Wales and Northern Ireland,
(ii)a member State (other than the United Kingdom),
(iii)a contracting third country,
means any highway and any other road to which the public has access, and includes bridges over which a road passes; and
(b)in relation to Scotland, means any road within the meaning of the Roads (Scotland) Act 1984(1) and any other way to which the public has access, and includes bridges over which a road passes. ”.
