The Water Act 2014 (Commencement No. 8 and Transitional Provisions) Order 2017

The Secretary of State makes this Order in exercise of the powers conferred by sections 91(1) and 94(3) of the Water Act 2014(1).

Citation and interpretation

1.—(1) This Order may be cited as the Water Act 2014 (Commencement No. 8 and Transitional Provisions) Order 2017.

(2) In this Order—

“the 1991 Act” means the Water Industry Act 1991(2);

“the 2014 Act” means the Water Act 2014.

Provisions of the 2014 Act coming into force on 6th March 2017

2.  The following provisions of the 2014 Act come into force on 6th March 2017—

(a)section 32 (interim duty: sewerage services) so far as it inserts section 110K into the 1991 Act;

(b)section 56 (further amendments) so far as it relates to paragraph (c);

(c)paragraph 64 of Schedule 7 (further amendments).

Transitional provisions

3.—(1) The time specified in a notice served on a water undertaker under section 63AA(1) or section 63AB(1) of the 1991 Act(3) after which the undertaker will no longer be required to provide a supply of water to the premises must not be before 1st April 2017.

(2) The time specified in a notice served on a sewerage undertaker under section 110K(1) of the 1991 Act(4) after which the undertaker will no longer be required to provide sewerage services to the premises must not be before 1st April 2017.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order is the eighth commencement order made under the Water Act 2014 (c.21) (“the 2014 Act”) in relation to England and Wales.

Article 2 commences provisions in the 2014 Act amending provisions of the Water Industry Act 1991 (c.56) which allow a water or sewerage undertaker’s non-household customers to notify the undertaker that water supply or sewerage services to their premises are instead to be provided by a water supply or sewerage licensee. The notice is to specify the time after which the undertaker will no longer be required to provide water supply or sewerage services to those premises. Article 3 contains a transitional provision so that the notice served cannot specify a date prior to 1st April 2017.

Impact assessments of the effect that the 2014 Act will have on the costs of business, the voluntary sector and the public sector are available from the Water Services Team, Department for Environment, Food and Rural Affairs, Nobel House, 17 Smith Square, London SW1P 3JR and are published alongside the 2014 Act at www.legislation.gov.uk . No separate impact assessment has been produced for this instrument.

2014 c.21. The power in section 94(3) to appoint a day on which the remaining provisions of the 2014 Act come into force is vested in the “appropriate authority”. Section 94(6) provides that the appropriate authority is the Secretary of State except as stated in the table in Schedule 12.

Sections 63AA and 63AB were inserted by paragraph 17 of Schedule 8 to the Water Act 2003 (c.37) and amended by paragraphs 63 and 64 respectively of Schedule 7 to the 2014 Act.
