Coming into force

The Secretary of State, in exercise of the powers conferred by section 188(1) to (5) of the Energy Act 20041, makes the following Regulations.

Citation, commencement and extent1

These Regulations may be cited as the Electricity (Necessary Wayleaves and Felling and Lopping of Trees) (Charges) (England and Wales) (Amendment) Regulations 2017 and come into force on 6th April 2017.

These Regulations extend to England and Wales only.

Amendment to fees for relevant applications2

The Electricity (Necessary Wayleaves and Felling and Lopping of Trees) (Charges) (England and Wales) Regulations 20132 are amended as follows.

In regulation 3 (fees for a relevant application), for “£34” substitute “£236.50”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Electricity (Necessary Wayleaves and Felling and Lopping of Trees) (Charges) (England and Wales) Regulations 2013 insofar as they specify the fee payable when making a relevant application to the Secretary of State under paragraphs 6(3) or 9(5) of Schedule 4 to the Electricity Act 1989 (c. 29).

Regulation 2 increases the fee payable for such applications by replacing the existing fee of £34 with a fee of £236.50. The new fee will apply to applications made on or after 6th April 2017 when these Regulations come into force.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen.
