The Criminal Justice and Courts Act 2015 (Commencement No. 5) Order 2016

The Lord Chancellor makes the following Order in exercise of the powers conferred by section 95(1) and (6)(a) of the Criminal Justice and Courts Act 2015(1).

Citation and interpretation

1.—(1) This Order may be cited as the Criminal Justice and Courts Act 2015 (Commencement No. 5) Order 2016.

(2) In this Order, “the Act” means the Criminal Justice and Courts Act 2015.

Provisions of the Act coming into force on the day after this Order is made

2.  The following provisions of the Act come into force on the day after this Order is made—

(a)section 68(1) (upper age limit for jury service to be 75), so far as it relates to section 68(3) of the Act; and

(b)section 68(3).

Provisions of the Act coming into force on 1st December 2016

3.  The following provisions of the Act come into force on 1st December 2016—

(a)section 68(1), so far as it is not already in force; and

(b)section 68(2).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force section 68 of the Criminal Justice and Courts Act 2015 (c. 2), which amends the Juries Act 1974 (c. 23) (“the Juries Act”) to increase the upper age limit for jury service from 70 to 75. Section 68(2) amends section 1(1)(a) of the Juries Act which makes provision about qualification for jury service. Section 68(3) amends section 3(1) of the Juries Act which directs electoral registration officers to give to such officer as the Lord Chancellor may designate copies of the electoral register marked up to indicate those who are aged under (those under 18) or over (those who are 76 or over) the age at which people qualify for jury service.
