The A5036 Trunk Road (Switch Island West Curve) (Detrunking) Order 2016

The Secretary of State for Transport makes this Order in exercise of the powers conferred by sections 10 & 12 of the Highways Act 1980(1), and now vested in him by The Transfer of Functions (Transport) Order 1981(2):

1.  This Order may be cited as the A5036 Trunk Road (Switch Island West Curve) (Detrunking) Order 2016 and shall come into force on 7th July 2016.

2.  In this Order –

(a) “principal road” as a classification for a highway, means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State; and

(b) “the trunk road” means the A5036 Dunnings Bridge Road Trunk Road (Switch Island West Curve).

3.  The length of the trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a principal road from the 7th July 2016.

SCHEDULE LENGTH OF THE TRUNK ROAD CEASING TO BE A TRUNK ROAD

The length of the trunk road ceasing to be a trunk road is situated between points ‘A’ and ‘B’ and is shown by broad black dashes on the plan marked “The A5036 Trunk Road (Switch Island West Curve) (Detrunking) Order 2016.” signed by authority of the Secretary of State for Transport and deposited at Document Deposit Service, Communities and Local Government, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order has the effect of detrunking a section of the A5036 Dunnings Bridge Road forming the western half of the original layout junction of the M57 and M58 special roads with the A5036 trunk road and A59 principal roads known as Switch Island.

This section of road named in the Order shall be transferred to Sefton Council coincident with authority (Reference S/2010/1050) granted by Sefton Council under Town and Country Planning (Development Management Procedure) (England) Order 2010 Town and Country Planning (Control of Advertisements) (England) Regulations 2007 Planning (Listed Buildings & Conservation Areas) Act 1990 Planning (Hazardous Substances) Act 1990 and Planning & Compensation Act 1991 on 25^th January 2011 for the Thornton to Switch Island Link road and agreements made by the Secretary of State for Transport with Sefton Council under Section 6 of the Highways Act 1980.
