The Civil Enforcement of Parking Contraventions Designation Order 2016

This Order is made in exercise of powers conferred by paragraph 8(1) of Schedule 8, and paragraph 3(1) of Schedule 10, to the Traffic Management Act 2004(1) (“the 2004 Act”).

The Council of the City of Wakefield has applied to the Secretary of State for an order to be made in exercise of those powers, in respect of part of that council’s area.

The Borough Council of Gateshead has applied to the Secretary of State for an order to be made in exercise of those powers, in respect of part of that council’s area.

The Dorset County Council has applied to the Secretary of State for an order to be made in exercise of those powers, in respect of part of that council’s area.

In accordance with the requirements of paragraph 8(3) of Schedule 8, and paragraph 3(4) of Schedule 10, to the 2004 Act, the Secretary of State has consulted the chief officers of police of West Yorkshire Police, Northumbria Police and Dorset Police.

Accordingly, the Secretary of State(2) makes this Order.

Citation and commencement

1.  This Order may be cited as the Civil Enforcement of Parking Contraventions Designation Order 2016 and comes into force on 13th June 2016.

Revocation of previous orders

2.  The following orders are revoked—

(a)the Road Traffic (Permitted Parking Area and Special Parking Area) (Metropolitan Borough of Gateshead) Order 2007(3);

(b)the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Dorset) (District of East Dorset) Order 2002(4); and

(c)the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Dorset) (District of West Dorset) Order 2002(5).

Designation of civil enforcement areas and special enforcement areas under the Traffic Management Act 2004

3.—(1) The Secretary of State designates each of the areas mentioned in paragraph (2) as—

(a)a civil enforcement area for parking contraventions; and

(b)a special enforcement area.

(2) The areas are—

(a)the part of the area of The Council of the City of Wakefield specified in Schedule 1;

(b)the part of the area of The Borough Council of Gateshead specified in Schedule 2; and

(c)the part of the area of The Dorset County Council specified in Schedule 3.

Article 3(2)(a)

SCHEDULE 1The part of the area of The Council of the City of Wakefield designated as a civil enforcement area for parking contraventions and as a special enforcement area

The whole of the area of The Council of the City of Wakefield except—

(a)the M1 motorway from the district boundary with Barnsley Metropolitan Borough at Ordnance Survey national grid reference point SE429770412080 to the boundary with Leeds Metropolitan District at Ordnance Survey national grid reference point SE429500423020;

(b)the M62 motorway from the district boundary of Leeds Metropolitan District at Ordnance Survey national grid reference point SE437835425155 to the boundary of North Yorkshire County Council at Ordnance Survey national grid reference point SE452980422380;

(c)the A1M motorway from its junction with the A1 at Ordnance Survey national grid reference point SE448615421100 to the boundary of Leeds Metropolitan District at Ordnance Survey national grid reference point SE447210426680;

(d)the A1 from the boundary with the Doncaster Metropolitan Borough at Ordnance Survey national grid reference point SE451060413640 to its junction with the A1M at Ordnance Survey national grid reference point SE448615421100; and

(e)the A162 from its junction with the A1 at Ordnance Survey national grid reference point SE448615421100 to its junction with the top of the north bound slip road at M62 junction 33 at Ordnance Survey national grid reference point SE448400422700 including the junction 33 roundabout and slip roads.

Article 3(2)(b)

SCHEDULE 2The part of the area of The Borough Council of Gateshead designated as a civil enforcement area for parking contraventions and as a special enforcement area

The whole of the area of The Borough Council of Gateshead except—

(a)the A1(M) from the boundary of the Durham County Council at Ordnance Survey National Grid reference point NZ2833754205 to junction 65 of the A194(M)/A1(T) at Ordnance Survey National Grid reference point NZ2835356328, including its on and off slip roads;

(b)the entire length of the A1(T) within the borough from junction 65 of the A1(M)/A194(M) at Ordnance Survey National Grid reference point NZ2835356328 to the boundary of the City of Newcastle upon Tyne at Ordnance Survey National Grid reference point NZ1944164007, including its on and off slip roads; and

(c)the entire length of the A194(M) within the borough from junction 65 of the A1(M)/A1(T) at Ordnance Survey National Grid reference point NZ2835356328 to the boundary of the City of Sunderland at Ordnance Survey National Grid reference point NZ2838156541 and from the boundary of the City of Sunderland at Ordnance Survey National Grid reference point NZ3001359757 to the boundary of the Metropolitan Borough of South Tyneside at Ordnance Survey National Grid reference point NZ3108161252, including its on and off slip roads.

Article 3(2)(c)

SCHEDULE 3The part of the area of The Dorset County Council designated as a civil enforcement area for parking contraventions and as a special enforcement area

The whole of the area of East Dorset District Council and West Dorset District Council except—

(a)all sections of the A31 trunk road, including its on and off slip roads, from the Winterborne Zelston Civil Parish Boundary at Ordnance Survey National Grid reference point SY9056097610 to the county boundary at Ordnance Survey National Grid reference point SU1394005010;

(b)the A338 road, including its on and off slip roads, from its junction with the A31 trunk road at Ashley Heath at Ordnance Survey National Grid reference point SU1328004370 to the East Dorset District boundary at Ordnance Survey National Grid reference point SZ1310099730; and

(c)all sections of the A35 trunk road in the area of West Dorset District, including its on and off slip roads, for the whole of its length in the district between Ordnance Survey National Grid reference point SY8129094820 to the county boundary at Ordnance Survey National Grid reference point SY3291096190.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order designates part of the area of each of The Council of the City of Wakefield, The Borough Council of Gateshead and The Dorset County Council as a civil enforcement area for parking contraventions and as a special enforcement area for the purposes of Part 6 of the Traffic Management Act 2004 (c. 18).

This Order also revokes the Road Traffic (Permitted Parking Area and Special Parking Area) (Metropolitan Borough of Gateshead) Order 2007 (S.I. 2007/1583) made under the predecessor designation scheme contained in the Road Traffic Act 1991. The roads that were excluded by the 2007 Order are now included within the designated area except for the A1(T), A194(M) and the A1(M) which is a new exclusion.

This Order also revokes the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Dorset) (District of East Dorset) Order 2002 (S.I. 2002/1485) and the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Dorset) (District of West Dorset) Order 2002 (S.I. 2002/1486) all made under the predecessor designation scheme contained in the Road Traffic Act 1991 (c. 40).

An impact assessment has not been produced as no impact on the private or voluntary sectors is foreseen. An Explanatory Memorandum is available alongside the instrument on the UK legislation website, www.legislation.gov.uk.

The Secretary of State is, by virtue of section 92 of the Traffic Management Act 2004, the ‘appropriate national authority’ as regards England for the purposes of Part 6 of that Act.
