Coming into force

The Secretary of State makes the following Order in exercise of the powers conferred by sections 51(1) and (2), 64(5) and (6) and 273(1) of the National Health Service Act 20061.

Citation and commencement1

This Order may be cited as the NHS Foundation Trusts (Trust Funds: Appointment of Trustees) Amendment (No. 2) Order 2016 and comes into force on 1st January 2017.

Amendment of the NHS Foundation Trusts (Trust Funds: Appointment of Trustees) Order 20072

In Schedule 1 (NHS Foundation Trusts for which trustees are to be appointed) of the NHS Foundation Trusts (Trusts Funds: Appointment of Trustees) Order 20072, omit “Chelsea and Westminster Hospital NHS Foundation Trust”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the NHS Foundation Trusts (Trust Funds: Appointment of Trustees) Order 2007 (S.I. 2007/1766) (“the Appointment Order”), which provides for the appointment of trustees for the NHS foundation trusts specified in Schedule 1.

Article 2 of this Order amends the Appointment Order to remove from the list of foundation trusts for which the Secretary of State must appoint trustees in Schedule 1, the Chelsea and Westminster Hospital NHS Foundation Trust.

A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
