10.  Paragraph 8 does not apply to the [F1 person] in respect of a party who is— U.K.

(a) a trader; and

[F2 (b) obliged under an enactment, rules of a trade association, or term of a contract, to accept the solution proposed by the person if the consumer accepts the solution.]
