Amendment of the National Health Service (General Medical Services Contracts) (Prescription of Drugs etc) Regulations 2004 E+W

1.  In the National Health Service (General Medical Service Contracts) (Prescription of Drugs etc) Regulations 2004 M1 , in Schedule 2 (drugs, medicines and other substances that may be ordered only in certain circumstances: interpretation)—

(a) for the definition of “general medical practitioner” substitute—

““general medical practitioner” has the meaning given in regulation 3 of the National Health Service (General Medical Services Contracts) Regulations 2015;”, and

(b) for the definition of “patient” substitute—

““patient” has the meaning given in regulation 3 of the National Health Service (General Medical Services Contracts) Regulations 2015;”.

2.  In regulation 2 of the Primary Medical Services (Sale of Goodwill and Restrictions on Sub-contracting) Regulations 2004 M2 (interpretation), for the definition of “GMS Contracts Regulations” substitute—

““GMS Contracts Regulations” means the National Health Service (General Medical Services Contracts) Regulations 2015;”.

“(i) regulation 79 of the National Health Service (General Medical Services Contracts) Regulations 2015;”.

5.  In regulation 2 of the National Health Service (Functions of the First-tier Tribunal relating to Primary Medical, Dental and Ophthalmic Services) Regulations 2010 M5 (interpretation), for the definition of “GMS Contracts Regulations” substitute—

““GMS Contracts Regulations” means the National Health Service (General Medical Services Contracts) Regulations 2015;”.
