The National Park Authorities (England) (Amendment) Order 2014

The Secretary of State, in exercise of the powers conferred by section 63(1) and (5) of, and paragraphs 1(2) and (3), and 2(1) and (2) of Schedule 7 to, the Environment Act 1995(1), makes the following Order.

In accordance with paragraph 2(3) of that Schedule, the Secretary of State has consulted the council for every principal area the whole or any part of which is comprised in Dartmoor National Park, Exmoor National Park, Lake District National Park, Northumberland National Park or North York Moors National Park.

Citation and commencement

1.  This Order may be cited as the National Park Authorities (England) (Amendment) Order 2014 and comes into force on 5th May 2014.

Amendment of the National Park Authorities (England) Order 1996

2.—(1) The National Park Authorities (England) Order 1996(2) is amended as follows.

(2) For Part 1 of Schedule 1 (membership of National Park authorities), substitute the text set out in the Schedule to this Order.

(3) In Part 2 of that Schedule—

(a)in the entry relating to Dartmoor National Park Authority, for the number of members for Devon County Council, substitute “5”, and for the number of members for West Devon Borough Council, substitute “2”;

(b)in the entry relating to Lake District National Park Authority, for the number of members for Cumbria County Council, substitute “5”, and for the number of members for South Lakeland District Council, substitute “2”; and

(c)in the entry relating to North York Moors National Park Authority, for the number of members for North Yorkshire County Council, substitute “4”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the National Park Authorities (England) Order 1996 (S.I. 1996/1243) so as to alter the prescribed membership of the National Park authorities (“NPAs”) for Dartmoor, Exmoor, Lake District, Northumberland and North York Moors National Parks.

The total membership of Dartmoor NPA is reduced from 22 to 19, that of Lake District NPA is reduced from 22 to 20, that of Northumberland NPA is reduced from 22 to 18, and that of North Yorks Moors NPA is reduced from 22 to 20.

For Dartmoor NPA, the appointments by Devon County Council, West Devon Borough Council and the Secretary of State are each reduced by one, from 6, 3 and 10 to 5, 2 and 9 respectively, and the number of members appointed by the Secretary of State as parish members remains unchanged.

For Exmoor NPA, the membership remains unchanged except that, of the 10 members appointed by the Secretary of State, the number appointed as parish members is increased from 4 to 5.

For the Lake District NPA, the appointments by Cumbria County Council and South Lakeland District Council are reduced from 6 and 3 to 5 and 2 respectively, and, of the 10 members appointed by the Secretary of State, the number appointed as parish members is increased from 4 to 5.

For Northumberland NPA, the number of members appointed by the Secretary of State is reduced from 16 to 12, but within that, the number appointed as parish members remains unchanged.

For North York Moors NPA, the appointments by North Yorkshire County Council and the Secretary of State are reduced from 5 and 12 to 4 and 11 respectively, and the number of members appointed by the Secretary of State as parish members remains unchanged.

A full regulatory impact assessment has not been prepared for this instrument as no impact on the private or voluntary sectors is foreseen.
