The Electricity Act 1989 (Exemption from the Requirement for an Interconnector Licence) (Amendment) Order 2014

The Secretary of State, having consulted the Authority(1), makes the following Order in exercise of the powers conferred by section 5(1) and (8) of the Electricity Act 1989(2).

The Secretary of State has given notice of the proposal to make this Order in accordance with section 5(2) and (11) of that Act. No representations in respect of the proposal have been made.

Citation and commencement

1.  This Order may be cited as the Electricity Act 1989 (Exemption from the Requirement for an Interconnector Licence) (Amendment) Order 2014 and comes into force on 20th October 2014.

Amendments to the Electricity Act 1989 (Exemption from the Requirement for an Interconnector Licence) Order 2006

2.—(1) The Electricity Act 1989 (Exemption from the Requirement for an Interconnector Licence) Order 2006(3) is amended as follows.

(2) In article 2—

(a)omit the definition of “MEA”;

(b)after the definition of “the Moyle Interconnector” insert—

MUA” means the Manx Utilities Authority, a statutory board established by the Transfer of Functions (Manx Utilities Authority) Order 2014(4);; and

(c)omit the definition of “NIE”.

(3) In article 3—

(a)in paragraph (a), for “MEA” substitute “MUA”;

(b)at the end of paragraph (b), insert “and”;

(c)in paragraph (c), for “; and” substitute “.”; and

(d)omit paragraph (d).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Electricity Act 1989 (Exemption from the Requirement for an Interconnector Licence) Order 2006 (S.I. 2006/2002) (“the 2006 Order”) in the following ways.

In respect of the electricity interconnector between Great Britain and the Isle of Man, this Order terminates the exemption from section 4(1)(d) of the Electricity Act 1989 (c.29) (which prohibits participation in the operation of an electricity interconnector without a licence) granted by the 2006 Order to the Manx Electricity Authority (“MEA”) and grants an exemption to the Manx Utilities Authority (“MUA”). The functions of the MEA were transferred to the MUA by the Transfer of Functions (Manx Utilities Authority) Order 2014 (S.D. 2014/6).

In respect of the electricity interconnector between Great Britain and Northern Ireland (“the Moyle Interconnector”), this Order terminates the exemption from section 4(1)(d) of the Electricity Act 1989 granted to Northern Ireland Electricity plc (“NIE”) by the 2006 Order. NIE no longer participates in the operation of the Moyle Interconnector.

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
