The Lord President of the Council makes this Order in exercise of the powers conferred by section 43(1) of the Political Parties and Elections Act 2009(1).

Citation and interpretation

1.—(1) This order may be cited as the Political Parties and Elections Act 2009 (Commencement No.6) Order 2013.

(2) In this Order “the Act” means the Political Parties and Elections Act 2009.

Provisions coming into force on 22nd January 2013

2.  Subsections (1), (2) and (4) of section 27 (returning officers for elections to the European Parliament) of the Act come into force on 22nd January 2013.

Provision coming into force on 1st January 2014

3.  Section 27(3) of the Act comes into force on 1st January 2014.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings section 27(1), (2) and (4) of the Political Parties and Elections Act 2009 (c.12) into force on 22nd January 2013, and brings section 27(3) into force on 1st January 2014. Section 27 amends section 6 of the European Parliamentary Elections Act 2002 (c.24). Subsections (2) and (4) provide that the Greater London Authority returning officer is eligible to be designated by the Secretary of State as a returning officer for European Parliamentary elections. Subsection (3) provides that the local returning officers for European Parliamentary elections will be local authority returning officers, rather than returning officers for United Kingdom parliamentary elections.

2009 c.12. Article 3 of the Lord President of the Council Order 2010 (S.I. 2010/1837) provides that the powers conferred on the Secretary of State under section 43 are exercisable concurrently by the Secretary of State and the Lord President of the Council.
