The Secretary of State for Education makes the following Regulations in exercise of the powers conferred by sections 408, 537A and 563 of the Education Act 1996(1):

Citation and commencement

1.  These Regulations may be cited as the Education (Pupil Information and School Performance Information) (Miscellaneous Amendments) (England) Regulations 2013 and come into force on 12th February 2014.

Amendments to the Education (Pupil Information) (England) Regulations 2005

2.  The Education (Pupil Information) (England) Regulations 2005(2) are amended as follows.

3.  Schedule 1 is amended as follows—

(a)In paragraph 2—

(i)in sub-paragraph (1)(a) for the words “at the end of the first, second and third key stages” substitute “at the end of the first and second key stages”;

(ii)in sub-paragraph (1)(d) for the words “at the end of the second and third key stages” substitute “at the end of the second key stage”; and

(iii)omit sub-paragraph (3).

(b)In paragraph 3 in the definition of “brief commentary” for the words “second and third key stages” substitute “second key stage”.

4.  In paragraph 6(3) of Schedule 2 omit the words “or a foundation subject at the third key stage”.

Amendments to the Education (School Performance Information) (England) Regulations 2007

5.  The Education (School Performance Information) (England) Regulations 2007(3) are amended as follows.

6.  In Regulation 12ZA—

(a)in the heading, omit the words “and third”; and

(b)omit paragraph 2.

7.  In Schedule 8 omit Part 2.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Education (Pupil Information) (England) Regulations 2005 (“the 2005 Regulations”), which relate to the keeping, disclosure and transfer of information about the performance of school pupils. They also amend the Education (School Performance Information) (England) Regulations 2007 (“the 2007 Regulations”), which relate to the collection and publication of information about the performance of schools.

They remove the requirement in the 2005 Regulations on a head teacher to include key stage 3 assessment or attainment information (where applicable) in the annual report to parents.

They remove the requirement in the 2005 Regulations on the governing body of a maintained school or the local authority to include key stage 3 assessment information (where applicable) in the record it transfers to another school when a pupil ceases to be registered at the former school and becomes registered at the latter school.

They remove the requirement in the 2007 Regulations on the governing body of a maintained school or the proprietor of an Academy or a CTC(4) to provide key stage 3 pupil assessment information (where applicable) to the local authority or the Secretary of State.

An impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen.
