The Secretary of State for Health makes the following Regulations in exercise of the powers conferred by section 130A of the Mental Health Act 19831 and section 2(2) of the European Communities Act 19722 and sections 3B(1)(c), 6D(1), 7(1), 8, 14Z4, 14, 19, 73A(1)(f), 73B(2)(e), 75, 236, 269(2), (3) and (4), and 272(7) and (8) and 273(1) and (4) of the National Health Service Act 20063 and section 300(3) of, and Schedule 23 to, the Health and Social Care Act 20124.

The Secretary of State is a Minister designated for the purposes of section 2(2) of the European Communities Act 1972 in relation to the National Health Service5.
