16.—(1) Where, before the relevant date, the Institute, in connection with the promotion of clinical excellence and the effective use of available resources in the health service, has been directed by the Secretary of State to appraise the clinical benefits and costs of such health care interventions as may have been notified by the Secretary of State, and to make recommendations(1), paragraph (2) applies.
(2) Where this paragraph applies, on and after the relevant date, NICE must treat the direction as a direction given by the Secretary of State under regulation 7(1)(a).
