These Regulations may be cited as the Working Time (Amendment) (England) Regulations 2013.

These Regulations come into force on 1st October 2013.

These Regulations apply in England only.
Amendment of the Working Time Regulations 19982

Subject to regulation 3, the Working Time Regulations 19983 are amended as follows.

In regulation 13(4), after the word “agriculture”, in both places occurring, insert “in Wales or Scotland”.

In regulation 15(6), after the word “agriculture”, in both places occurring, insert “in Wales or Scotland”.

In regulation 43—
a
for the heading, substitute “Workers employed in agriculture in Wales or Scotland”;
b
after “agriculture”, insert “in Wales or Scotland”.

In Schedule 2—
a
in the heading, after “Agriculture”, insert “in Wales or Scotland”;
b
in paragraph 1, after the word “agriculture”, in each place occurring, insert “in Wales or Scotland”.
Saving provision3

Nothing in these Regulations applies to a worker employed in agriculture in England in relation to that employment if—
a
that employment commenced before 1st October 2013, and
b
the worker remains so employed under that employment.

In this regulation—
a
“worker”, “employment” and “employed” have the same meaning as in regulation 2(1) of the Working Time Regulations 1998;
b
“worker employed in agriculture” has the same meaning as in that regulation as in force immediately before 1st October 2013.
