Coming into force in accordance with article 1
1. This Instrument may be cited as “The Portsmouth City Council Access to Portsmouth (1) – Tipner Interchange, M275 Motorway Slip Roads Scheme 2009 Confirmation Instrument 2012” and shall come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.
2. The Portsmouth City Council Access to Portsmouth (1) – Tipner Interchange, M275 Motorway Slip Roads Scheme 2009 (“the Scheme”) is hereby confirmed without modifications.
3. The Scheme as confirmed is set out in the Schedule hereto (including the plan) and copies of the Scheme with its accompanying plan are deposited at the offices of the Department for Transport, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex, TN37 7GA, and at Portsmouth City Council, Civic Offices, Guildhall Square, Portsmouth, Hampshire, PO1 2BG.

Portsmouth City Council makes this Scheme in exercise of their powers under Sections 16 and 17 of the Highways Act 1980, and all other powers enabling them in that behalf—
1. The Council are authorised to provide for the use of traffic of Classes I and II of the classes of traffic set out in Schedule 4 to the Highways Act 1980, special roads along the routes described in the Schedule to this Scheme for the purpose of connecting the M275 Motorway with another highway at the place stated in that Schedule.
2. The centre lines of the special roads are indicated by heavy black lines on the plan.
3. In this Scheme—
(i)“the Council” means Portsmouth City Council;
(ii)“the Special Roads” means the special roads which the Council are authorised by this Scheme to provide;
(iii)“the plan” means the plan numbered SNPL177056/003 Rev B, marked “The Portsmouth City Council Access to Portsmouth (1) – Tipner Interchange, M275 Motorway Slip Road Scheme 2009”, sealed with the Common Seal of the Council and deposited at the Civic Offices, Guildhall Square, Portsmouth PO1 2AL; a duplicate has been deposited at the offices of the Secretary of State for Transport.
4. This Scheme may be cited as “The Portsmouth City Council Access to Portsmouth (1) – Tipner Interchange, M275 Motorway Slip Roads Scheme 2009”.
Four routes to connect the northbound and southbound carriageways of the M275 Motorway with Tipner Lane (as proposed to be improved by the construction of a roundabout beneath the M275 Motorway) at Tipner, all in the City of Portsmouth (the special roads along these routes being given the reference numbers 1, 2, 3 and 4 on the plan).

This Instrument confirms a Scheme to provide four special roads to connect the northbound and southbound carriageways of the M275 to a roundabout to be constructed beneath the M275 Motorway on Tipner Lane at Tipner, in the City of Portsmouth for the use of traffic of Classes I and II of the classes of traffic set out in Schedule 4 of the Highways Act 1980.
