PART 2 Amendments to the Environment Act 1995

Section 56

7.  In section 56(1) (interpretation of Part 1)—

(a) in the definition of “environmental licence”, both in relation to the Environment Agency and in relation to SEPA(1)—

(i) in paragraph (aa), insert at the end “, other than regulations made for the purpose of implementing the EU ETS Directive”; and

(ii) omit paragraph (k); and

(b) after those definitions, insert—

““the EU ETS Directive” means Directive 2003/87/EC of the European Parliament and of the Council establishing a scheme for greenhouse gas emissions allowance trading within the Community and amending Council Directive 96/61/EC, as amended from time to time;”.

In those definitions, paragraph (aa) was inserted by S.I. 2000/1973 and paragraph (k) by S.I. 2005/925; there are other amendments that are not relevant.
