The Scotland Act 2012 (Commencement No. 2) Order 2012

The Secretary of State makes the following Order in exercise of the power conferred by section 44(5) of the Scotland Act 2012(1).

Citation and interpretation

1.—(1) This Order may be cited as the Scotland Act 2012 (Commencement No. 2) Order 2012.

(2) In this Order, “the Act” means the Scotland Act 2012.

Appointed day of 31st October 2012

2.  The day appointed for the coming into force of the following provisions of the Act is 31st October 2012—

(a)section 8 (constituencies, regions and regional members);

(b)section 13 (exercise of power to make Order disqualifying persons from membership of the Parliament);

(c)section 17 (exercise of functions relating to Seirbheis nam Meadhanan Gàidhlig);

(d)section 19 (misuse of drugs);

(e)section 39 (maximum penalties which may be specified in subordinate legislation); and

(f)Schedule 1 (amendments of Schedule 1 to the 1998 Act).

Appointed day of 1st August 2013

3.  The day appointed for the coming into force of section 18 of the Act (Crown Estate Commissioner with special responsibility for Scotland) is 1st August 2013.

EXPLANATORY NOTE

(This note is not part of the Order)

Article 2 of this Order commences various provisions of the Scotland Act 2012 on 31st October 2012. The provisions include those which confer certain functions on the Scottish Ministers in relation to Seirbheis nam Meadhanan Gàidhlig (whose operating name is MG Alba) (section 17) and transfer functions of the Secretary of State to the Scottish Ministers in relation to the issuing of licences to doctors who may prescribe controlled drugs to addicts (section 19).

Article 3 of this Order commences section 18 of the Scotland Act 2012 on 1st August 2013. Section 18 amends the Crown Estate Act 1961 to provide that there must be a Crown Estate Commissioner with special responsibility for Scotland, appointed by Her Majesty on the recommendation of the Chancellor of the Exchequer who must first consult the Scottish Ministers before making that recommendation.
