Regulation 2 of these Regulations omits regulation 8 of the Education (School Government) (Terms of Reference) (England) Regulations 2000 (“the 2000 Regulations”), so that head teachers are no longer required to formulate a policy for the secular curriculum of their school for adoption by the governing body.
An impact assessment has not been produced for this instrument as it has no impact on businesses or civil society organisations. The impact on the public sector is minimal.

S.I. 2000/2122, to which there are amendments not relevant to these Regulations. Following the repeal of sections 38 and 44 of the School Standards and Framework Act 1998, these Regulations have effect as if made under sections 21(3) and 34(5)(e) of the Education Act 2002, by virtue of the section 17(2)(b) of the Interpretation act 1978.
